Dawn Photography's T&Cs of Booking

Photographic Agreement and Release -

RAFT MINI JUNE 2021

This Photographic Agreement and Release (“Agreement)” is between the Client/s and Dawn Photography (“Photographer”). I/We the Client/s allow Dawn Photography to photograph myself/us for the purposes of the package chosen.

Deposit and Payment: There is a $50 non-refundable deposit of the package total to secure your booking. Your session date will not be secure until your non-refundable deposit has been received by Dawn Photography. The owing amount for the session is due on the day of the session. I/We acknowledge that the images taken in the session, will not be released until the session has been paid in full. Should the Client/s not show up to the scheduled session, cancel the appointment or otherwise breach this agreement, the non-refundable deposit will be held as damages to Dawn Photography.

Creative License: The images are edited at the Photographers discretion. Dawn Photography reserves the creative rights to select, edit and release the images deemed of high professional quality, creditable and of the Photographer’s artistic standards. I/We understand that the Photographer will, under no circumstances, provide any unedited or RAW images to the Client/s. Dawn Photography has the right to edit the images in the way of their artistic style, colour correction, exposure correction, shadow and highlight recovery, lens correction, and colour enhancement. Dawn Photography’s editing does not include any photoshopping or extensive retouching other than minor skin corrections, including pimples or bruises.

Cooperation and Liability: I/We consent to cooperating and communicating with Dawn Photography to achieve the best possible result. I/We acknowledge the Photographer has a style of working to achieve a beautiful gallery. I/We release the Photographer from all liabilities that may arise during the session. I/We understand there may be poses suggested, props, or different locations used to create the images. I/We have the right to refuse any poses, props, or locations at any time if I/We feel unsafe. Dawn Photography holds the right to refuse any suggested poses or the use of props by the Client if any safety concerns arise.

Copyright: Dawn Photography has Copyright of all images. The Photographer grants permission to the Client/s to make copies for personal use. Publication or Commercial use of the photographs is not allowed without prior written consent from the Photographer. The Client/s agree under these copyright terms to not edit or manipulate the images in any way, including, but not limited to photoshopping or Instagram filters.

Printing: I/We understand that Dawn Photography cannot be held responsible for any errors in prints, canvases, or albums, including, but not limited to loss of quality, incorrect colouring, incorrect cropping, and printing faults that are not ordered through Dawn Photography’s printing store. I/We understand that the Photographer does not recommend, although I/We are welcome to do so, printing at any consumer photo printing labs due to the above listed issues.

In the unlikely event the Photographer is too unwell, injured or has a personal emergency preventing them photographing the session, Dawn Photography will contact the Client/s as soon as reasonably possible to reschedule to date and time of the session. In the chance of illness, weather, equipment malfunction or COVID or government restrictions, then I/We understand the session will be rescheduled to a later date. I/We understand that this does not qualify the Client/s for a refund. I/We agree that if a date or time cannot be agreed to by both parties for the booked session, that the paid amount towards the booking will be held in credit to be used towards another session with Dawn Photography. I/We agree that Dawn Photography is not liable for any costs for any third-party appointments booked by the Client/s beforehand. 

STANDARD MODEL RELEASE (USE OF IMAGES ON SOCIAL MEDIA/ WEBSITE/ ADVERTISING/ PRINT MEDIA)*

I give my consent to Dawn Photography to publish, republish or otherwise transmit images of myself/us at the booked photo session in any medium for all purposes. I hereby waive the right to inspect and approve any of the images that may be used. I further release Dawn Photography from any form of damage, foreseen or unforeseen, associated with the use of the images. I/We acknowledge that I have the right to sign on behalf of all individuals present at the photo session.

*If you do not give your consent for the Standard Model Release, please let us know at the time of making your booking or by email reply after you have booked.
